Gestational surrogacy is legal in India and supported by the Indian government, which is currently taking a proactive role to enhance the process for all parties involved.
A baby carried by a gestational surrogate mother has no genetic relation to her, because the biological parents' eggs and sperm samples are used to create an embryo that is later transferred to the surrogate mother's uterus. Sometimes a mother cannot provide her own eggs for her surrogacy program, in which case an egg from an egg donor is used.
